Poker is well-acknowledged as a game that needs high intellect and mental prowess. Globally, statisticians, economists, and chess grandmasters acknowledge that poker requires high skill. Except for Andhra Pradesh, Sikkim, Nagaland, Assam, Arunachal Pradesh, Tamil Nadu, Odisha, and Telangana, all Indian states exempt “games of skill” or “games of mere skill” from the concept of gambling.

Alignment with Indian Laws

In 1996, a three-judge bench of the Supreme Court upheld its 1967 ruling and ruled that games requiring a substantial and preponderant degree of skill fell within the description of ‘games of mere skill,’ adding that horse-racing betting is a game of skill beyond the scope of gambling.

According to several Supreme Court decisions, offering games of skill is a fundamental right under the Indian constitution; hence, skill games cannot be disallowed.

The High Courts of Karnataka and Calcutta have determined that law enforcement agencies cannot intervene with poker games. Based on this legal context, various legal experts and jurists have concluded that Internet poker is legal in India.

We comply with all applicable rules and regulations for skill-based online games. In addition, we shall cooperate with any court ruling, regulatory body, central or state government, or law enforcement agency that modifies our current legal standing.

However, this is an ongoing process with current litigations in multiple forums, and we are carefully monitoring it. We also have a legal team continuously striving to ensure that the gaming regulations in India are becoming increasingly evident and solid. We are also engaged in litigation to bring about this clarity in the law. While every step has been taken to ensure the website’s legality, gamers are recommended to check their local laws if they have any doubts.

All Indian states and union territories except Andhra Pradesh, Assam, Odisha, Nagaland, Tamil Nadu, Arunachal Pradesh, Sikkim, and Telangana are permitted to participate. Due to the unusual phrasing of gambling laws in several states, we do not currently allow residents of these states to play poker for real money.
